Terms of Service

1. Acceptance of Terms

By accessing or using ConjureForge (the "Service"), operated by Malkarian Enterprises Pty Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free, Starter, Pro, and Enterprise tier users.

2. Description of Service

ConjureForge is an AI-powered platform that enables users to design, build, deploy, and manage software applications using autonomous AI agents. Features include a natural-language builder, autonomous ConjureLoop agent, agent studio, connector integrations, and app publishing. The Service is provided "as is" and "as available". We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Account Registration

You must register an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be 18 years or older (or the age of digital consent in your jurisdiction) to register. You may not create accounts on behalf of others without their consent. We reserve the right to suspend or terminate accounts that violate these terms.

4. Forge Credits and Billing

ConjureForge uses a credit system ("Forge Credits") to meter usage. Credits are consumed by build operations, agent runs, AI model calls, and connector actions. Credit costs are displayed in the platform before actions are executed. Subscription plans include a monthly credit allocation. Unused credits do not roll over unless you are on the Pro or Enterprise plan. Top-up credit packs can be purchased at any time. All fees are in USD unless otherwise stated. Payments are processed by Stripe. Subscriptions auto-renew unless cancelled. Refunds are issued at our discretion within 14 days of a charge if the Service has not been materially used. You may bring your own API keys (BYOK) for certain AI providers, which bypasses per-call credit charges for model inference. BYOK keys are stored encrypted and used only for your requests.

5. Acceptable Use

You agree not to use ConjureForge to: — Build, deploy, or distribute malware, spyware, or any software designed to harm, exploit, or surveil individuals without consent — Generate or distribute illegal content, including material that violates copyright, defames individuals, or constitutes fraud — Attempt to circumvent rate limits, access controls, or security measures — Scrape, extract, or replicate the platform's AI models, training data, or proprietary systems — Use the platform for bulk spam, phishing, or unsolicited messaging — Violate the terms of any connected third-party service (e.g. Google, GitHub, Slack) We reserve the right to suspend accounts that violate these terms without refund.

6. Intellectual Property

You retain full ownership of the code, applications, and content you create using ConjureForge. We do not claim any intellectual property rights over your output. The ConjureForge platform, brand, UI, and underlying systems are owned by Malkarian Enterprises Pty Ltd. You may not reproduce, reverse-engineer, or create derivative works from the platform itself. Feedback or suggestions you provide to us may be used to improve the Service without obligation or compensation.

7. Data and Privacy

Your use of data within ConjureForge is governed by our Privacy Policy, incorporated by reference. You are responsible for ensuring you have the right to use any data, code, or content you upload to the platform. We may access your project data to provide technical support, debug incidents, or comply with legal obligations. We do not access or use your project data for any other purpose.

8. Limitation of Liability

To the maximum extent permitted by law, ConjureForge and Malkarian Enterprises Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption. Our total aggregate liability to you shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or AUD $100, whichever is greater. Some jurisdictions do not allow limitation of liability for certain claims. In those jurisdictions, liability is limited to the minimum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Malkarian Enterprises Pty Ltd, its directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your breach of these terms.

10. Modifications and Termination

We may update these terms at any time. Material changes will be communicated by email with at least 14 days notice. Continued use after the effective date constitutes acceptance. You may terminate your account at any time via Settings → Account → Delete Account. We may terminate accounts for violations of these terms. Upon termination, your access ceases and your data is scheduled for deletion per our retention policy.

11. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Brisbane, Queensland, or via binding arbitration if both parties agree. If any provision of these terms is held to be unenforceable, the remaining provisions remain in full force.
